1. Acceptance of Terms

By downloading, installing, or using the Avyro.ai mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Avyro.ai provides AI-powered fitness coaching, workout programming, and health data analysis through a mobile application. The service uses artificial intelligence to generate personalized training recommendations based on user-provided data and connected health devices.

3. Eligibility

You must be at least 16 years of age to use Avyro.ai. By using the App, you represent that you meet this age requirement. Users under 18 should have parental or guardian consent.

4. Account Registration

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree to provide accurate, current, and complete information during registration.

5. Subscription and Payments

• Avyro.ai offers a free tier with limited features and a paid subscription ("Avyro Pro") at $4.99/month.
• Subscriptions are billed monthly through the Apple App Store or Google Play Store.
• Your subscription automatically renews unless canceled at least 24 hours before the end of the current billing period.
• Refunds are handled by Apple or Google according to their respective refund policies.
• Avyro.ai offers a 30-day free trial for new subscribers. You will not be charged during the trial period.

6. Health and Fitness Disclaimer

Avyro.ai is not a medical service. The App provides general fitness and training recommendations generated by artificial intelligence. These recommendations are not medical advice, diagnosis, or treatment.

• Always consult a qualified healthcare professional before starting any new exercise program, especially if you have pre-existing medical conditions, injuries, or health concerns.
• The AI coach is not a licensed medical professional, physiotherapist, or dietitian.
• Nutrition suggestions are general guidelines and not tailored medical dietary advice.
• If you experience pain, dizziness, shortness of breath, or any adverse symptoms during exercise, stop immediately and seek medical attention.
• Avyro.ai is not liable for any injuries, health issues, or damages resulting from following AI-generated recommendations.

7. Health Data

Avyro.ai may access health data from Apple Health, Google Health Connect, Garmin, Oura, or WHOOP with your explicit permission. This data is used solely to personalize your training recommendations. See our Privacy Policy for details on how health data is handled.

8. User Conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws.
• Post or transmit abusive, threatening, harassing, or offensive content in group chats or social features.
• Attempt to interfere with or disrupt the App's infrastructure or other users' experience.
• Impersonate another person or entity.
• Use automated systems or bots to access the App.
• Reverse engineer, decompile, or disassemble any part of the App.

Avyro.ai reserves the right to suspend or terminate accounts that violate these terms.

9. Content Moderation

Group chats and social features are subject to content moderation. Users can report inappropriate content or block other users. Avyro.ai reserves the right to remove content or suspend accounts that violate community guidelines without prior notice.

10. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, software, and AI-generated workout programs, are the property of Avyro.ai and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without written permission.

11. Account Deletion

You may delete your account at any time through the App's Settings screen. Upon deletion:

• Your account and all associated data will be permanently deleted.
• This includes your profile, chat history, workout data, health data, and AI memories.
• This action is irreversible.
• Active subscriptions should be canceled separately through the App Store or Play Store.

12. Limitation of Liability

To the maximum extent permitted by law, Avyro.ai and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, health issues, loss of data, or loss of profits, arising from your use of the App.

13. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. Avyro.ai does not warrant that the App will be uninterrupted, error-free, or that AI-generated recommendations will be suitable for your individual health circumstances.

14. Modifications to Terms

Avyro.ai reserves the right to modify these Terms at any time. We will notify users of material changes through the App or via email. Continued use of the App after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of Norway. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Trondheim, Norway.
